1. Acceptance of Terms
By accessing or using Deskmatic ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Deskmatic provides an AI-powered phone receptionist service that answers incoming calls, collects caller information, and delivers structured summaries to business owners via SMS, email, and an online dashboard. The Service includes phone number provisioning, call handling, AI conversation, call transcription, and notification delivery.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. The Service is available only to users located in the United States with a valid US phone number and US-issued payment method.
4. Subscriptions and Billing
The Service is offered on a subscription basis with monthly billing. Free trials may be available with limited features and usage. Subscriptions renew automatically unless canceled. You may cancel at any time through the billing portal. Upon cancellation, your provisioned phone number may be released.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal, fraudulent, or harmful purpose
- Attempt to abuse, overwhelm, or exploit the Service's resources
- Use the Service to harass, threaten, or deceive callers
- Misrepresent the AI receptionist as a human being to callers when required by law to disclose
- Resell or redistribute the Service without written permission
- Attempt to reverse-engineer, modify, or tamper with the Service
6. AI Disclaimer
The Service uses artificial intelligence to handle phone conversations. While we strive for accuracy, AI responses may occasionally be imperfect. Deskmatic is not liable for any errors, misunderstandings, or missed information in AI-handled calls. The Service should not be used as a substitute for professional medical, legal, or emergency services.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. Call recordings, transcripts, and caller information are stored securely and used solely to provide the Service.
8. Limitation of Liability
Deskmatic is provided "as is" without warranties of any kind. In no event shall Deskmatic be liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months prior to the claim.
9. Termination
We may suspend or terminate your account if you violate these Terms. Upon termination, your data may be deleted after a reasonable retention period. You may export your data before cancellation using the dashboard export features.
10. Changes to Terms
We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms. We will notify active subscribers of material changes via email.
